The DMEPOS community has an important opportunity to protect access to vital urological and ostomy supplies for Medicare beneficiaries. Rep. Greg Murphy (R-NC) and Rep. Brad Schneider (D-IL) have introduced H.R. 10787, bipartisan legislation that would amend Title XVIII of the Social Security Act to exclude urological and ostomy supplies from Medicare competitive acquisition programs for five years.
While introduction of the bill is an important first step, it will only become law if Congress acts. The legislation has been referred to committee and now needs additional congressional support to move forward through the legislative process.
Why This Legislation Matters
The Centers for Medicare & Medicaid Services (CMS) has indicated its intent to include urological and ostomy supplies in a future Medicare Competitive Bidding Program. Many patient advocates, clinicians, and suppliers have voiced concerns that applying competitive bidding to these highly individualized products could disrupt care for beneficiaries who depend on specific supplies to maintain their health, independence, and quality of life.
Unlike standardized medical equipment, ostomy and urological supplies are often selected based on individual clinical needs. Product substitutions can lead to complications such as skin breakdown, leakage, infections, and other adverse health outcomes that may require additional medical intervention.
H.R. 10787 would provide a five-year exclusion from competitive bidding, helping ensure that Medicare beneficiaries continue to have access to the products and supplier expertise they rely on every day.
What We Need From Members
Now is the time for our industry to engage.
We encourage all members to contact their U.S. Representative and ask them to:
- Cosponsor H.R. 10787.
- Support efforts to advance the bill through committee and floor consideration.
- Recognize the unique clinical needs of patients who depend on urological and ostomy supplies.
- Protect beneficiary choice and access to specialized supplier services.
Members should also educate referral sources, patient advocates, and community stakeholders about the potential impact of competitive bidding on these critical product categories.
